Trust Gives Heirs Triple Benefit: In January 1999, a trust set up by Mitt Romney for his children and grandchildren reaped a 1,000 percent return on the sale of shares in Internet advertising firm DoubleClick Inc. If Romney had given the cash directly, he could have owed a gift tax at a rate as high as 55 percent. He avoided gift and estate taxes by using a type of generation-skipping trust known to tax planners by the nickname: ?I Dig It.??

The Obama administration proposed cracking down on the tax benefits in February?. Romney or his trust received shares in DoubleClick eight months before the company went public in 1998. The formal name for Romney?s shelter is the Ann and Mitt Romney 1995 Family Trust. Capital gains, interest and dividends from its holdings accounted for about a quarter of Romney?s 2011 income of $13.7 million. Romney set up his trust in 1995?. Here?s how they work: the person setting up the trust, like Romney, contributes assets such as an interest in a fund or shares in a company. If he makes that contribution before those assets appreciate -- particularly when they are privately held and difficult to value -- he can claim the gift tax obligation is low or non-existent since the declared value is low or zero.

If the trust generates any income -- such as by selling stock -- the eventual tax bill is the responsibility of Romney, not the trust. By paying the capital gains tax, which was 20 percent in the late 1990s and is now 15 percent, he can avoid depleting the funds in the trust -- in essence making an additional donation that?s free of gift taxes. That benefit in particular makes this type of trust ?a more powerful driver of wealth transfer in estate planning than almost anything else,? said Breitstone, the wealth preservation attorney?.

Bloostein, who didn?t respond to a request for comment, said it was common during the 1990s for lawyers to advise clients to value their stake in a fund?s future profits -- called carried interest in the private equity world -- at zero for gift tax purposes, according to his presentation reviewed by Bloomberg News?

A new survey of 236 members of the National Association for Business Economics finds a majority of those experts say Matt Varilek's approach of combining spending cuts with increased taxes is the best way to reduce the deficit. And those tax breaks for the rich to which Rep. Noem is so committed are boosting the debt without much promise of economic stimulus.

Romney jokes about Clinton?s influence on the 2012 election

NEW YORK?Months after he used former President Bill Clinton in ads to attack President Barack Obama, Mitt Romney finally shared a stage with the 42nd president. In an address at the Clinton Global Initiative's annual conference, Romney argued that the United States needs to retool how it allocates foreign aid.

Ahead of his speech, Romney poked fun at Clinton's influence on the 2012 race. After Clinton praised the former Massachusetts governor's support for the service programs City Year and AmeriCorps, Romney joked about the former president's glowing introduction.

"If there's one thing we've learned this election season, it's that a few words from Bill Clinton can do any man a lot of good," Romney said. "After that introduction, I guess all I have to do is wait a day or two for the bounce."

In his speech, Romney outlined plans for a "new approach" to America's foreign aid system, arguing that the U.S. should tie development assistance to requirements that would remove trade barriers to allow for greater U.S. investment and the spread of free enterprise.

"Ours is a compassionate nation. We look around us and see withering, suffering. Our hearts break," Romney said. "But too often our passion for charity is tempered by our sense that our aid is not always effective. We see stories of cases where American aid has been diverted to corrupt governments. We wonder why years of aid and relief seem never to extinguish the hardship, why the suffering persists decade after decade."

Romney argued that temporary aid under the current program can "jolt an economy" but "it can't sustain an economy" because "at some point, the money runs out." He insisted that a foreign aid program should be designed to foster private enterprise and job creation that would have a longer-lasting impact on a country's future.

Romney never directly referenced his Democratic opponent, but his speech was clearly meant to serve as a contrast to Obama's foreign policy approach, which has occurred against the backdrop of unrest in the Middle East and North Africa. The president speaks before the United Nations Tuesday about his policies.

Romney's speech came a day after he criticized Obama's comments on CBS' "60 Minutes" over the weekend, where the president suggested the recent outbreaks of violence overseas were just "bumps in the road." The Romney campaign immediately seized on the remark, suggesting that Obama was downplaying the death of Chris Stevens, the U.S. ambassador to Libya, and other Americans killed in attacks on U.S. diplomatic missions abroad.

Romney made no mention of Obama's comments but offered an implied criticism of the president's policies, arguing that the way to curb violence in the Middle East is to offer not simply foreign aid but opportunities for "work."

"That must be at the heart of our effort to help people build economies that can create jobs for people, young and old alike. Work builds self-esteem. It transforms minds from fantasy and fanaticism to reality and grounding," Romney said. "Work will not long tolerate corruption nor quietly endure the brazen theft by government of the product of hardworking men and women."

In a clear dig at Obama, Romney said if he wins the White House, he hopes to "remind the world of the goodness and bigness of the American heart."

"I will never apologize for America.?I believe that America has been one of the greatest forces for good the world has ever known," Romney said. "We can hold that knowledge in our hearts with humility and unwavering conviction."

Investing in property can be a real boost to your income, if done correctly, according to John Roberts, chief executive officer of Just Property Group.

It is critical to have a strong contingency plan as a safety buffer that can potentially tide over the repayments and living costs for three to six months should that need arise.

Property investment can be complicated, but a sound property strategy is a vital component of a well-rounded portfolio.

He explains that one way for growing a property portfolio is a process known as ?gearing? - specifically leveraging the first property to acquire a second investment property.

Anyone entering the property market for the first time takes into consideration several essential aspects.

The most important among these is whether they are prepared for the investment and responsibility that accompanies home ownership, followed fairly swiftly by the research to establish available options, neighbourhoods and restrictions imposed by financial limitations.

There is the underlying realisation that home ownership is a major commitment, not entered into lightly and that property acquisition affects financial well-being both immediately and for the foreseeable future.

Roberts says the same considerations come into play for investment properties. An initial venture into buying a second property means not making a rash decision, since the long-term nature of property can see buyers paying heavily for ill-conceived acquisitions.

Taking the time to build a solid foundation of knowledge will pay long-term dividends and enable investors to confidently acquire their first rental property second, third and fourth.

?Gearing? is therefore the method used to acquire a second property by using the first one as a stepping stone, he points out.

South African taxation allows investors to write off certain expenses incurred by the investment property against the income accumulated from the rentals.

Take the time to build a solid foundation of knowledge as this will pay long-term dividends and enable investors to confidently acquire their first rental property second, third and fourth.

Those expenses include the interest on the bond repayments (note it is only the interest and not the percentage of the monthly repayments credited to the capital); municipal levies, rates and taxes, as well as legitimate maintenance, but not upgrading.

Hence, the business model means having no or a limited bond on the primary residence, where there are no tax benefits to holding a bond, and maximising the bond on the investment property, he says.

The codicil is that in using the residential property as the security against the investment property, investors stand the risk of losing both homes should the deal turn sour, specifically if one cannot meet dual bond repayments.

It is therefore critical to have a strong contingency plan as a safety buffer that can potentially tide over the repayments and living costs for three to six months should that need arise.

The second property should then be geared to allow for the?purchase of a third. This becomes effective when the capital repaid on the second property has been reduced to the extent that the rental income exceeds the tax deductable expenses and the property now accumulates taxable income.

Before that point has been reached, investors need to realise that acquiring a second property, even if through gearing, will have a significant impact on the monthly cash flow. This means taking into account having the financial stability to service both bonds and the associated costs of home ownership.

The next element for consideration is the rental income that can realistically be achieved from that property. When compared against the expenses incurred on the property - bond repayment, rates, levies and taxes - it reflects the deficit that has to be funded from the current monthly household income.

Ensuring that servicing the bond does not become an issue, investors must purchase properties that are well located and that can continue generating a constant income to become self-supporting.

Translating that into commonsense means acquiring a property in an area where tenants are lined up waiting for accommodation and where there has been a strong history of growth.

Remember though that anyone approaching the bank for a loan to buy property will not be able to include the rental income into their assets and liabilities projections unless there is a signed lease agreement in place on that property. This would only be realistically possible should the property be an occupied rental unit at the time of purchase.

Yet, an element too often overlooked in property acquisitions is paradoxically one of the most important elements on this investment trail. It is the question on why you want to enter the rental property market and it is crucial because, in answering that question, the investor can stay motivated and focused on that goal when tougher times hit, says Roberts.

Owning and managing real estate is not easy. It requires time, effort and organisation to bear fruits, but it also requires objectivity, a characteristic rarely found in property buying. By its nature, property acquisition is a subjective issue and what is deemed ideal by one is considered unsuitable by another.

That objectivity comes into play when considering the goals for acquiring that property. If the goal is to achieve a certain return on investment over a specific time-frame (for example, five years), emotional attachment to that property cannot be a factor in the decision to sell when that time is reached, he adds.

The history of sex in Australia, from the eighteenth-century colony?s shortage of women to the age of Internet dating, will be the subject of a free public seminar at the University of New England on Friday 28 September.

Associate Professor Frank Bongiorno from the Australian National University began writing his recently-published book The Sex Lives of Australians during the seven years (2000 ? 2007) that he worked as a lecturer in history at UNE.

?My teaching at UNE included the history of sexuality, and I wrote the bulk of the book while I was in Armidale,? he said. ?It even includes a few examples, gleaned from the pages of The Armidale Express, of changing attitudes to sex in Armidale over the years.?

The Sex Lives of Australians: A History (Black Inc., Melbourne, 2012) is the first book to cover the history of Australian sexuality from 1788 to the present.

?Some of my students at UNE ? particularly older people with a passion for family history ? had some interesting stories to tell about the sex lives of their convict ancestors,? Dr Bongiorno said, ?and I realised that it was a set of stories worth the telling.

?In my talk, ?The sex lives of Australians: an historical reflection?, I?ll discuss what can be learnt from considering, in an integrated way, a whole range of topics ? prostitution, censorship, birth control, sexology, homosexuality and many others ? that have usually been treated separately.?

The seminar on Friday will be at 4 pm in Lecture Theatre A3, UNE Arts Building. Everyone is welcome.

?Being a ?settler society? sets colonised Australia apart from many older societies in this aspect of its history,? Dr Bongiorno said. ?That history includes relations between the settlers and Indigenous peoples on the early frontier, and the effect of a predominantly male population throughout much of the nineteenth century on the development of the culture of ?mateship?.

?There?s also the preoccupation with race at a time when Australia was intent on building a white society on the doorstep of Asia, and when the main function of sex was seen as the production of white Australians.?

?The campaign for gay marriage ? a major issue today ? was not a prominent part of mainstream gay politics until relatively recently,? he recalled. ?In the 1970s, the gay movement tended to be suspicious of institutions such as marriage, and it was only after a general cultural shift away from the stereotype of the patriarchal family that the idea gained more appeal.?

Dr Bongiorno has held lecturing positions at King?s College London and Griffith University as well as at UNE, and Visiting Fellowships at the University of Cambridge and the University of Texas at Austin. He is a member of the editorial boards of the Journal of Australian Studies, History Australia, and the Australian Journal of Politics and History.

Clinton presses Rwanda, DRC leaders on border crisis

NEW YORK (Reuters) - U.S. Secretary of State Hillary Clinton pressed the presidents of Rwanda and the Democratic Republic of Congo to resolve a conflict over rebels in eastern Congo whose military advances have stoked tensions in one of Africa's most volatile regions.

Clinton sat down with Rwandan President Paul Kagame and Congolese President Joseph Kabila in New York on Monday, delivering a firm message to both that steps must be taken to resolve the crisis, a senior U.S. official said on Tuesday.

Clinton's unadvertised meeting, her first joint session with the two feuding African leaders, was aimed at underscoring U.S. concern over the M23 rebel group, which the Democratic Republic of Congo (DRC), the United States and U.N. experts have all said are receiving support from neighboring Rwanda.

"The secretary sent a signal of our concern over what is happening in the region, and the need for both of these leaders to find a way to defuse tensions," said the U.S. official, speaking on condition of anonymity.

"It is imperative that they take action," the official said.

Clinton's meeting comes ahead of a U.N. meeting on the crisis set for Thursday, one of a series of events taking place alongside the U.N. General Assembly meeting in New York this week.

It also follows a U.S. decision in July to withdraw some $200,000 in military aid for Rwanda, Washington's first direct punitive action against the Rwandans. Several other western European nations have also cut or suspended aid.

Rwanda has denied having any link to eastern Congolese rebels, including the M23 group, who have been fighting Congolese government soldiers in North Kivu province since April, displacing some 470,000 civilians.

A senior U.N. official, speaking on condition of anonymity, said that faith and trust need to be established between Rwanda and Kabila. He said Kabila had described his confidence in Rwanda as "zero."

While Rwanda has denied any involvement in eastern DRC, the official said that privately: "They are a bit embarrassed, to say the least, and this could be one of the reasons behind the lull (in fighting) in the Kivu."

He said that if Rwanda withdrew support for M23 then the group "could be subdued."

DE FACTO ADMINISTRATION

U.N. peacekeeping chief Herve Ladsous said this month that rebel forces had established a de facto administration in eastern Congo, challenging the authority of Kabila's government and strengthening their hold over the territory.

A U.N. mission in the DRC, known as MONUSCO, has more than 17,000 troops, but the force is stretched thin across a nation the size of Western Europe and struggles to fulfill its current mandate of protecting civilians.

The U.S. official said Clinton did not explicitly warn Kagame that the further U.S. assistance could be at risk, but said she did emphasize that both leaders bear responsibility for reducing tensions.

"The secretary made no threats," the official said. "But it is important for Rwanda to cease any support for any groups operating against the government of the DRC, and it is important for the DRC government to take steps to protect all of its citizens."

Last month, the DRC said it had asked the U.N. Security Council to place sanctions on Rwanda's defense minister and two top military officials for backing the rebellion, although the United States and other powers are urging more time for political dialogue.

As uneasy neighbors, Congo and Rwanda have gone to war with each other in the past.

Eastern Congo's enduring conflict, which has killed, maimed and displaced several million civilians over nearly two decades, has its roots in Tutsi-Hutu ethnic and political enmities dating back to the 1994 Rwandan genocide.

Later invasions of Congo by Rwandan forces and Rwanda's backing of Congolese rebels fuelled two crippling wars.

The lightweight, cylindrical Human Support Robot (HSR) responds to voice commands as well as a graphic interface on a tablet computer. Its key feature is a folding arm with a two-finger gripper that can pick up stuff from the ground, open curtains, reach high shelves, and other tasks, according to Toyota.?

The arm is about?2.5-feet long and can lift objects weighing up to 2.7 pounds and 5.1 inches wide, which is sufficient to pick up a dropped remote control or fetch an ice cold beer from the fridge.

The 70 pound machine was designed to assist independent home living for people with limited arm or leg mobility. Top speed is only 1.8 miles per hour and the arm moves with insufficient force to cause much trouble, making it safe for indoor, at home use, according to Toyota.?

The robot "can also wear a tablet computer atop its head, which would allow caregivers and family members to communicate with the robot's owner over Skype or other services,"?Gizmag noted?in a story about the robot.

While a price isn?t set for the HSR, it could sell well among Japan?s aging population where insurance will pick up 70 percent of associated costs thanks to a recently passed law to encourage robot technology for elder care.

HSR is just one of many robots?under development that are being designed to work with humans in all kinds of situations from the factory floor to the surface of?Mars.

Engadget visits Nokia House, walks down memory lane

It's not the first time Engadget editors have stepped foot at Nokia House -- the company's HQ in Espoo, Finland -- but it's always a treat, and our visit this week is no exception. Today we took a walk down memory lane, and spent some time with several Nokia handsets -- from one of the very first mobile phones to the Lumia 920. We played with some of the more iconic models and designs, such as the 1011 (first GSM handset), 7700 / 7710 (S90), 7280 (lipstick phone), 770 tablet, N-Gage / QD, 8800, 8110 (from the Matrix movie), N93 / N93i, N91, N92, N76, N95 and finally the 7650 (the first handset running Symbian). In addition, we also got to handle some of the Lumia 820 and 920 accessories, including the Fatboy wireless charging pillow and JBL-branded Power Up speakers. EU limits use of biofuels

The European Union announced new laws aimed at limiting crop-based biofuels to only 5 percent of transport fuel used in the region, according to Consumer Energy Report.

The European Union announced a major change in its biofuel policy earlier this week, making clear that new laws aimed at limiting crop-based biofuels to only 5 percent of transport fuel used in the region will soon be introduced, putting the biofuel industry itself in peril.

The decision is being made in order to allow room for so-called ?advanced biofuels,? a source of energy made from waste products that the EU hopes will take the lead in the industry. This would allow more crops, such as grains and sugar, to be used to feed the world?s population, a cause that has been championed by groups influential enough to paint a negative public image of the biofuel industry at large. Despite this hope, industry analysts are adamant that Europe?s biofuel sector will take a hit that it cannot recover from, predicting near-immediate closures of biofuel plants throughout the EU that will lead to thousands of lost jobs. With the industry itself heavily invested in meeting the current energy target dictated by previous EU policy ? 10 percent biofuel as transport fuel by the year 2020 ? the potential economic impact is severe. ?It?s a big U-turn in EU policy,? said Jean-Philippe Puig, chief executive of French oilseed group Sofiproteol, the parent company of the EU?s largest biodiesel producer. ?We have made lots of investment in order to meet the 10 percent target in 2020, including more than 1 billion euros in biodiesel plants in France.?

Because the European Union government body behind the proposal will need to have the policy change approved by governments and the European Parliment before it can be implemented as law, the process itself is expected to take up to two years to complete. Given that both sides of the debate are heavily invested in the outcome, with both humanitarian concern and bank accounts on the line, lively campaigning from all involved is to be expected as the issue plays out.

Zoo mauling: Man wanted to be 'one with the tiger'

Officials at the Bronx Zoo confirm that a 25-year-old man jumped into the tiger exhibit from a passing train on Friday. NBC's Michelle Franzen reports.

NEW YORK -- The man who jumped out of the Bronx Zoo's monorail into the tiger exhibit is expected to face criminal charges, according to law enforcement officials.

Investigators now believe that David Villalobos was not attempting to commit suicide Friday afternoon when he?made the leap into the tiger den. Villalobos, 25, was mauled by a Siberian tiger before zoo employees rescued him by using fire extinguishers to distract the big cat, zoo officials said.


Based on Villalobos' statements to investigators and what they've seen on his Facebook page it appears he was obsessed with the tigers and just wanted to be with them, police said.

"The NYPD anticipates arresting David Villalobos on a trespassing complaint by Bronx Zoo authorities," police spokesman Paul Browne said Saturday. "When an NYPD sergeant asked Villalobos yesterday why had jumped into the tiger preserve, he replied that 'everyone has a reason for what they do in life.'"

According to Browne, Villalobos told NYPD detectives that his leap was definitely not a suicide attempt, but a desire to be "one with the tiger."

Villalobos told investigators he incurred most of his injuries from landing on all fours after the fall and that he recalled being dragged by the tiger by his foot, and afterwards being able to pet the tiger.

The tiger named Bachuta could have killed Villalobos who was in the enclosure for about 10 minutes, Bronx Zoo Director Jim Breheny said.

Officials reveal details about the attack of a 25-year-old man who apparently jumped into the tiger exhibit at The Bronx Zoo.

"Tigers are extremely capable predators: They typically grab a prey animal by the back of the neck and it's over very quickly," Breheny said. "This cat did not do this to the individual."

Villalobos, who is from Mahopac, suffered "various bites or puncture wounds on his arms and legs and also the top of his shoulder on his back,"? Breheny said. He also suffered a broken arm and ankle, perhaps from the 17-foot drop off the monorail. He is in stable condition at Jacobi Medical Center.

Though pricey for Texas, Austin a bargain by national standards

AUSTIN -- Austin is a growing city and inevitably there are growing pains.

"It's a lot more expensive and it's a lot more crowded," said Phil Rugeley, who's been living in Austin since the 1970s.

"It used to be cheaper, it's getting more expensive," said Austin resident Courtney Link who said compared to other places she's lived in, Austin ranks among the middle of the road in terms of expenses.

"Rent is up than the way it used to be, but where isn't it like that?" said Ian Tennant, and Austin resident originally from Canada.

When it comes to cost of living, Austin is pricey by Texas standards.

According to Sperling's BestPlaces.net, a $50,000 income in Austin compares to about $43,000 in Dallas or Houston, but you'd have to make $20,000 to $50,000 more just to keep up in cities like Seattle, New York or San Francisco.

More and more people moving to Austin has driven the average cost of a home up to $215,000, but within the city itself prices can vary significantly.

"It depends," said Rugeley. "If you're living on South Congress it's a little bit pricey, but that's supply and demand."

"You pick your spots and you're okay," said Tennant. "I don't have to drive that much so I'm not paying for gas, so that's kind of big."

On the upside, Austin benefits from some of the cheapest gas prices in America, according to GasBuddy.com, averaging around $3.65 a gallon compared to well over four dollars on the East and West Coasts.

According to the U.S. Energy Information Administration, residential end user electricity prices in Texas are just below the national average.

When it comes to food, Austin has long enjoyed its reputation as a hub for local restaurateurs specializing in unique and affordable fare.

"If someone here complains about the price of their food, they need to travel," said Zar Lewellen, a developer from Seattle. "It's just dirt cheap."

Another unconventional economic barometer is the average price of a glass of beer. In Austin, the average pint of domestic beer runs between $3 and $5 dollars, but according to the website PintPrice.com, the same beer in a city like New York could run between $6 and $8 dollars.

"A six-pack of beer down here seems like cheap as get out compared to up there," Tennant said in comparison to his native Canada.

Any visitor can tell you much of Austin's attractiveness has nothing to do with money.

"I always enjoy coming down here because it's fun," said Lewellen. "Good barbecue, good beer, great Mexican food and some incredibly beautiful people."

For many, that in itself is a bargain.

Township Rec Registering for Winter Sports - Wyckoff, NJ Patch

The Wyckoff Department of Recreation and Parks will hold registration for its winter schedule in the Eisenhower cafeteria on Saturday, Sept. 22, from 10 a.m. to noon, and Tuesday, Sept. 25, from 7:30 p.m. to 9 p.m.

The wide range of basketball activities available include recreation basketball leagues for boys and girls in grades 3/4, 5/6 and 7/8, and a high school league.?

And, for the first time ever, first and second graders will be able to participate in our First/Second Grade Basketball Program!

The registration fee for first through fourth grades is $55 and for fifth through eighth grade the fee is $75.

Please note that third and fourth grade boys and girls will play games this year on Saturday mornings from December through early March and our first and second graders will play on Saturday afternoons in January and February.

In addition to our elementary and middle school basketball programs, local high school boys can also join our High School Basketball League which takes place on Monday nights from December through February. The registration fee for this program is $80.

Our popular adult open gym program will begin on Monday, Nov. 26 at Eisenhower School with pre-registration during the above dates required. Space in this program is limited to the first 100 Wyckoff residents who register on a first come, first served basis. The registration fee is $65.

Besides the extensive basketball programs, Wyckoff Recreation also offers traveling basketball cheerleading squads, wrestling for grades 2-8, and an indoor soft-stick lacrosse program for boys and girls in grades 1-2, which takes place on Saturday mornings. ?The registration fees are $55 for the first and second grade lacrosse program, and $75 for wrestling and cheerleading.

Finally, our very popular Roller Hockey Program will be accepting registrations on the dates above. Children in grades 2 and 3 will learn the game in our fun Roller Hockey Clinic on Monday nights and weekend afternoons from December through February and children in grades four through 12 (ages 9-17) will participate on our Wyckoff teams in the North Jersey Youth Roller Hockey League.

Practices will begin in November and continue with games through mid-March. The fees for this program are $55 for second and third graders and $75 for grades 4-12.

All Wyckoff residents are urged to join in the fun this winter. To ensure your placement in the program of your choice, be sure to sign up on Sept. 22 or 25.

US, EU approve Universal takeover of EMI

(AP) ? Universal Music Group got approval Friday from American and European regulators to buy the famed British music company EMI, including the hugely lucrative Beatles catalogue. But the EU imposed stringent restrictions on the deal, forcing Universal to sell some of EMI's biggest acts, such as Coldplay and Pink Floyd.

Among EMI's assets that must go is Parlophone, home to those two British bands as well as Kylie Minogue and David Bowie. The Beatles, which is part of Parlophone, was exempted.

Universal will also have to sell off EMI's classical music divisions, its French and other local branches and labels that are home to Depeche Mode and The Ramones.

The U.S. Federal Trade Commission said that Universal and Emi's businesses were different enough from each other that the deal wasn't anti-competitive. It added that it didn't see the need to impose the same conditions on the deal as European regulator because of the differences between the U.S. and European markets.

EU Competition Commissioner Joaquin Almunia said that the fact that the companies involved trade in music made the case a particularly emotional one.

"This has been one of the most difficult discussions in my life as commissioner for competition because of ... the existence not only of an industry ? we are used to dealing with mergers between companies in very different sectors ? but the existence of a cultural dimension," said Almunia.

The FTC's decision was the last hurdle that Universal, which already represents Jay-Z, Nirvana and U2, had to clear before it can go ahead with its $1.9 billion purchase of EMI's recorded-music division, where talent is nurtured.

Universal's rivals, like Warner Music and small independent labels, have strongly protested the deal, saying it could squeeze out other players.

"This decision has finally put a freeze on Universal's ability to expand further," Helen Smith, executive chair of Impala, an industry group for independent labels, said in a statement Friday. "However, this decision nonetheless reinforces what is already a powerful duopoly."

The Universal deal is one part of the break-up of EMI. Regulators have already allowed a group led by Sony Corp. to buy EMI's music publishing arm for $2.2 billion.

If the Universal deal goes through, its average market share in European countries would be less than 40 percent after the asset sales, Almunia said.

Simon Dyson, the editor of Music & Copyright, an industry newsletter, said it appeared Universal's global market share would rise from around 29 percent to 34.5 percent ? but that because the company was already such a big player, the acquisition was unlikely to drastically change the industry.

"A digital music service can't launch without a company that's got one-third of the world's music, but it also can't launch without a company that has one-quarter," he said. "I genuinely don't see this as big a deal as some of the critics."

Still, if the U.S. also approves the deal, it will mean that the number of major record labels drops from four to three.

Almunia said that was a concern for European regulators, and they are trying to remedy it by insisting that Universal sell about two-thirds of the assets they're getting rid of to one buyer, in the hopes of creating another significant player in the music business, even if it won't be as large as the old EMI ? which was already the smallest of the four "majors."

He hinted that the EU wouldn't want to see either Warner or Sony be the buyer of that chunk, although he said that it was up to Universal to decide whom they wanted to sell to.

Universal welcomed the announcement, brushing off suggestions that it is being forced to sell so much of EMI that the deal might not make sense any more.

"We are delighted Universal Music will retain over two-thirds of EMI on a global basis, contributing to the accretive nature of the deal," the company said in a statement.

The company noted that it is acquiring several iconic artists ? and particularly the Beatles collection. Almunia said the British sensation's songs were exempted from the Parlophone sale because companies themselves propose asset sales in competition negotiations. The regulator can only then approve or deny the proposal; it does not make its own recommendations for what should be sold off.

Dyson agreed that, even with the asset sales, Universal did pretty well.

"They've got arguably the two biggest bands in history ? the Beatles and the Rolling Stones," he said. "That's nothing to sniff at."

Computer simulations for multiscale systems can be faster, better, more reliable

ScienceDaily (Sep. 20, 2012) ? University of Oregon scientists have found a way to correctly reproduce not only the structure but also important thermodynamic quantities such as pressure and compressibility of a large, multiscale system at variable levels of molecular coarse-graining.

The method is a mathematically driven predictive modeling of a real system, built on liquid state theory, and utilizing powerful computing resources. The team's theory appears in the Sept. 21 issue of the journal Physical Review Letters.

Understanding multiscale systems is of vital importance in biology and material engineering. Because physical properties of multiscale systems develop on an extended range of times and lengths -- with changes involving many orders of magnitude -- computer simulations at the atomic resolution can exceed even the most advanced computational capabilities.

In recent years theoretical coarse-graining methods have gained attention in the scientific community because they provide an efficient alternative to traditional simulations, which represent explicitly every atom of the molecular system. In course graining, atomistic-level information is removed to make computations at long time- and large length-scales possible. The key issue is how to develop reliable and controllable coarse-graining procedures. Most coarse-graining methods correctly predict the structure of a liquid, but they fall short in predicting thermodynamic properties such as pressure or compressibility.

The new theory has the capability to ensure both structural and thermodynamic consistency, said Marina G. Guenza, professor of theoretical physical chemistry and project leader.

Last year, in the journal Physical Review E, Guenza and doctoral student Ivan Lyubimov, a co-author of the new paper, documented a procedure to reconstruct the realistic dynamics of multiscale systems from the motion measured in dynamic simulations of coarse-grained macromolecules. In this newly published article, the same coarse-graining formalism is shown to reproduce correctly the pressure and compressibility of the system, providing a reliable method to simulate complex macromolecular systems in an extended range of length and timescales.

Thermodynamic properties are important in the mixing of liquid materials used in making plastics, said Anthony J. Clark, a UO doctoral student in physics and lead author of the new paper. "Pressure has been a high-level issue in coarse-graining," he said. "It is important to be able to reproduce the distribution of molecules in a system, and pressure is a hard physical quantity to predict. Our theory now will provide the interaction potentials of coarse-grained molecules, which correctly predict both the structure and the thermodynamics of the sample."

The improvements to the formula for the computational simulation mean that manufacturers soon may be able to use a computer code and input information for the materials they plan to mix and quickly determine the behavior of a finished product, said Guenza, a member of the UO's Institute of Theoretical Science, Materials Science Institute and Institute of Molecular Biology.

A problem in working with polymers, for example, is that they often don't blend easily. Controlling for thermodynamic components is vital.

"These molecules are very complex," said co-author Jay McCarty, a doctoral student in chemistry who derived the equations that prove the thermodynamic consistency of Clark's potential and ran the atomistic simulations the test the theory. "They move at different timescales and cover many lengthscales. Our goal is to bridge phenomena that happen at different scales at the molecular level."

Many manufacturing processes rely on often costly, time-consuming and wasteful trial-and-error procedures. While the scientific program is still under development to be extended to a larger number of systems, Guenza said, the recent developments have addressed major stumbling blocks.

On the horizon, she said, is a web-based computer program at the UO, which manufacturers and researchers will be able to access to run predictive coarse-graining simulations that will facilitate the study of polymeric systems and improve the efficiency of working with these samples.

"Dr. Guenza's work to improve our understanding of multi-scale systems has the potential to create new efficiencies in research and manufacturing," said Kimberly Andrews Espy, vice president for research and innovation, and dean of the graduate school. "It reflects the University of Oregon's commitment to re-engineering the science, manufacturing and business processes related to critical products with the aim of fostering a more sustainable future for our planet and its people."
