Relying on reports in Chinese media, the blog Shanghaiist describes the gaping hole as more than 3,200 square feet in area and almost 30 feet deep, and still expanding.?

The Sydney Morning Herald reports that the sinkhole opened up near a subway construction site. Workers noticed that the land was sinking and managed to evacuate the 300 or so people inside the buildings before they collapsed. It is not clear whether the construction caused the sinkhole.

Sinkholes are often caused by the underground erosion of salt beds or soluble sedimentary rocks, such as limestone or dolomite. Groundwater flows through these rocks, creating subterranean caverns that can suddenly collapse.

In the past couple of years, large sinkholes have appeared in?Guatemala City; Tampa,?Fla.,?Quebec; Milwaukee; as well as Germany and Florida.?

Sky-high bacteria could affect climate, scientists say

A team of storm-chasing scientists sampling rarefied air has found a world of bacteria and fungi floating about 30,000 feet above Earth. The findings, detailed Monday in the Proceedings of the National Academy of Sciences, suggest that microbes have the potential to affect the weather.

Scientists have long studied airborne bacteria, but they typically do so from the ground, often trekking to mountain peaks to examine microbes in fresh snow. Beyond that, they don't know much about the number and diversity of floating microbes, said study coauthor Athanasios Nenes, an atmospheric scientist at Georgia Tech.

To get a glimpse of this hovering world, Nenes and his colleagues hitched several rides on a NASA aircraft as onboard instruments sampled the air before, during and after hurricanes Earl and Karl in 2010. The plane flew into the upper troposphere, about 6 miles above the surface.

During nine flights ? most over the Caribbean and the midwest Atlantic ? the researchers ran the outside air over a series of filters, each time capturing material from an average of 212 cubic feet of ambient air. They sampled a variety of environments, from the cloudy masses that preceded Hurricane Earl to the cloud-free air after Hurricane Karl passed.

The researchers focused on a ribosomal RNA gene called SSU rRNA, which can reliably identify bacterial species. They calculated that there were about 144 bacterial cells per cubic foot of air.

The bacteria accounted for 20% of the particles in their size range ? stuff that scientists had assumed was just sea salt and dust.

"We were surprised," Nenes said.

The filters picked up fungi too, though in concentrations that were at most only 10% as high as for the bacteria.

The microbial populations were very different before and after a storm, Nenes said; that makes sense, given that hurricanes have the potential to kick a fresh batch of bugs into the air.

Among other types, the scientists found Escherichia and Streptococcus bacteria in their samples ? microbes typically associated with human and animal feces that could have been thrown into the air as the storms swept through populated areas.

The researchers identified 17 types of bacteria that were found in all the samples, leading the team to suspect that those organisms constituted a core microbiome for the lower atmosphere. These bacteria must have developed traits that allowed them to bear freezing temperatures, feed on the scarce carbon compounds in cloud dust and survive in an environment bombarded by ultraviolet radiation.

Other studies have revealed the presence of plant-based microbes that are thought to induce freezing in order to damage leaves and then infect them.

Microbes with this freezing ability could conceivably collect water vapor and seed clouds, causing them to release rain. It could very well represent a way of transporting microbes across continents, Nenes said.

That possibility also has implications for the ways in which illnesses spread, he added.

"Once you get to that altitude, if you can survive, you can basically circulate the Earth very quickly," Nenes said. "You can start out in Europe and end up in Asia."

The finding could be exciting for astrobiologists, who wonder about the extreme environments in which bacteria can live on Earth ? and whether they could do so on other planets as well.

"It definitely lends to the idea that life is pretty resilient and you can adapt to almost any environment if you have a bare minimum of sustenance," Nenes said.

The paper provides a fascinating preliminary census of the airborne microbes, said David Sands, a bacteriologist at Montana State University who was not involved in the study.

But such research has a long way to go before proving that microbes in the atmosphere are doing anything other than waiting for their slow fall back to Earth, he added.

"If they go up, they want to get back down," Sands said.

Most of us have insurance benefits through our employer or we pay for our plans privately. ?Some employers offer Medical, vision, dental, and other types of insurance. ?They are typically optional plans. ?Here is the general differences of these types of insurances.

Medical Insurance plans

Medical insurance generally covers toward medical care, i.e., you go to the doctor for a problem or emergency. ?So for a general medical visit, this may consist of an ache or pain, rash, infection, or fever, just to name a few. ?Not ALL physicians are on ALL medical insurances. ?You should have been provided information regarding providers in your area, or the insurance website can be very helpful to search for one.?

Vision Insurance plans

Vision insurance generally covers?(or ?provides a benefit?)?towards eye exams and medical devices such as prescription eyewear and prescription contact lenses. ?They usually do NOT cover problem visits like, eye infections, red eyes, or other acute eye issues. ?These types of issues would be more of a medical visit and can usually be filed with your medical plan, if your eye clinic provides insurance?filing and?are providers on your plan. ?There are usually copays for most vision plans?as well as medical plans?that are due upon the time services are rendered.

Also, there are not any vision plans out?there?(that I am aware of) that will cover 100% of your vision care needs. ?Most only pay a very small percentage of your eye exam, glasses or contact lens supplies. ?Please note that most of the time, you will be responsible for overages at the time services are rendered in most eye clinics.

Dental Insurance plans

Dental plans generally covers various dental procedures. ?I am not as savvy on this particular type of plan, but I know through my personal experience, they are similar to vision plans?only cover?some things?and most expensive procedures are not billable to the dental plans OR medical plans. ?The best way to find out more about your particular dental plan is to contact your dental insurance.

Premiums, Deductibles and Co-pays

Ugh!!! ?Don?t we pay enough to these insurance companies already?! ?Most insurance plans are NOT free!! ?Someone has to pay ? the members and providers. ? Most employers offer various medical, vision, and dental benefits of some kind, at a less expensive premium (supposedly). ?You should be aware of how much is being deducted from your check monthly and know what your coverage and deductibles are. ?It may be more cost effective for you to be on your own independant insurance plan(s)?or put those premiums toward a Health Savings Account. ?These premiums that are deducted from your pay, should be pre-tax funds.

Once your coverage is activated, then you will likely owe the insurance more money before they start paying for your exams or office visits. ?This is called a deductible. ?It varies from one insurance plan to the next and they typically start over year to year. There may be an individual deductible and a family deductible. ?Either way, be aware of what your deductibles are. ?If you are not aware of them, please contact your HR department or your insurance company.

At your office visits, you may ?have a co-pay that may or may not go toward your deductible. ?This is something else you need to be aware of prior to your visits. ?Be prepared to pay your co-pays at the time the services are rendered.

How do I make life easier and my office visits more efficient?

Regardless of how you have insurance coverage, either through an employer or independantly, here are some helpful pointers to note.

- Find out the full name and contact information of the Human Resource Department and keep on file as you may need to call them a few times.
- Have ALL your insurance information available when you call to make your appointments. ?This includes subscriber/member name that is on the insurance (not nicknames), DOB (date of birth) of the member and the patient, subscriber/member ID number and patient ID number if different, Group number, insurance address and phone number.
- Be aware of your benefits. ?This can be a challenge sometimes, but you should have been provided a manual of your benefits, or have access to their website. ?If you do not have this information, it is likely that your doctor?s office does not have it either. ?Please call your HR department or call your insurance company. ?The number for members/subscribers is on the back of the card. ?Please note,?that most medical clinics do NOT have a direct line to any of the insurance companies either, so the wait time is just as long on the phone.
- Be aware if you have met your deductible or not. ?This is something your doctor?s office will definitely NOT know, so please contact your insurance company.
- Be aware of your copays or expect to pay some sort of copay. ?Most range from $10 to $50 depending on the insurance. ?Often times it will be on your card as well. ?Various clinics may be a ?specialty? clinic. ?You can call that clinic to find out what they are considered.
- Be prepared to pay 100% of the services rendered when you go to any of your doctor?s visits unless you prearranged something. ?Meaning, you called prior to your appointment and discussed this with the billing/accounting department at your doctor?s office.

We mentioned earlier today that 49ers wide receiver Randy Moss declared himself the best wideout in the history of the game.

You?ll likely see much more about him in the coming days, in many outlets, because he was so open and forthcoming and illuminating about many topics during his appearance at Media Day.

When Moss is on, he?s extremely interesting, he just chooses not to be on often.

But among the gems today was a candid admission that he didn?t particularly care for the way the 49ers used him this year.

In the past, it could have been a Keyshawn-level ?Just Give Me the Damn Ball? routine, but Moss said it so matter-of-factly it was easy to miss.

?I don?t like my role; I don?t,? he said. ?I like to be out there playing football. One thing that I?ve always had to really understand was being a decoy. It was put to me, Coach Dennis Green just said, ?Even though the football is not in your hand, you?re still out there dictating how the defense is playing the offense.? It took me awhile to really understand where he was coming from. Later on and now in my career, I understand that my presence out on the field, I don?t always have to touch the ball to be able to help the offense score touchdowns.

?Like I said, I don?t really like that, but it?s something that I?m used to. I have to grow to understand and grow to like it. I?ve always been a team player. I?ve never been about self. Anything that is going to push our team to victory and hopefully win a Super Bowl, I?m willing to do.?

But 49ers offensive coordinator Greg Roman said Moss had been nothing but professional.

His love of competition has never been in doubt. Moss joked about past arguments, even fights, he?s had with coaches and players. But his role with the 49ers, as much as he might not like it, remains a valuable one, as Roman insisted Moss could still ?get behind a defense in a hurry.?

?When I hear people talk about how talented I am and how easy I make it look, I can honestly tell you people that it?s very hard work,? Moss said. ?I work out five times a week. I put the work in and for me to be able to go out there and have results it something I am proud of. It?s not always the individual results that I?m proud of. For me to be able to talk to a Michael Crabtree or talk to a Frank Gore or Percy Harvin and for them to go out there and have a good game that week, that?s something I can be proud of. That?s just me giving back to the NFL.

?I?ve always said, I don?t like what the NFL does for me because I?m very blessed. My family is blessed. I?ve always been the type of person to know what I can do to make the League better. At this point in my career, if I?m able to be vocal, to share a little knowledge and also to go out there and play, if that?s what it takes to win a championship, then I?m willing to do that. I?ve always been that way.?

The municipal government of Jakarta recently announced that it?s going mobilize a team of 2,000 scavengers to clean the city?s streets as an answer to a growing garbage problem. What is interesting is that they said they are going to pay each of these new sanitation employees 2 million rupiah per month, which is around US$200 and close to the salary of a lower rung white collar worker.

Basuki explained that this effort would bring mutual benefit both for the scavengers and for reducing the amount of garbage in Jakarta. In addition, the scavengers can sort out the trash that still have value for sale and dump the rest of the trash accordingly.

?Yes, we will provide them with a fixed salary. If we spend Rp 2 million for 2,000 people then it?s only going to cost Rp 48 billion. It is better than having a Rp 75 billion budget yet all the garbage problems still exist? he said.

As Jakarta tries to kill two birds with one stone ? provide scavengers with work and good pay while at the same time getting a cleaner city ? many educated, white collar Indonesians have raised some pretty big objections:

There are currently tens of thousands of scavengers making a living in Jakarta by scouring the city?s landfills and garbage depots for scrap and recyclables. They are the ones who separate garbage from that which can be recycled, and fill a societal niche by doing the work nobody else will touch. But this does not mean that their work is necessarily appreciated, and scavengers sit on the bottom level of the city?s class system. It is even common for many businesses to display signs that say ?Pemulung Dilarang Masuk? (No Scavengers) on their doors.

Surprising perhaps, though dirty and treated as pariahs, many of Jakarta?s scavengers are not completely destitute. A report by the Guardians pegs them as making an average of 30,000 rupiah per day, which roughly adds up to around $90 per month. Scavenging is a full-fledged livelihood in Jakarta, and is one that the local government seems to be trying to step in and organize.

But there are many who seem to take this move as being an affront to their sense of class, which is often measured by salary anywhere in the world. If the people picking up garbage were paid the same as the people doing office work, what would be the status of the latter?

Status is little more than a social construct, but all cultures are ordered by it. Perhaps unfortunately, status is all too often based on income rather the role that a particular person plays for society.

I personally think it?s a very tough job so 2 million is a very reasonable salary if not maybe more. I don?t think I could do work like that as I would rather be sitting behind a desk.

A salary is usually directly proportional with production output. If public service employees can take the morning off or spend half the day reading newspapers plus chit-chat then why should they be paid higher? If the scavengers are given targets to clean certain road perimeters and they can achieve the target, why not give them a salary of Rp. 2 million? Your diploma can only help so much as many people can still be successful despite the lack of a proper education. Ultimately, I believe that salary should be directly proportional to work output, otherwise it?ll be similar to our parliament members.

The appeal of getting an education should be so you don?t have to get down in a gutter and pick up your society?s trash. But it?s also my opinion that the incentive of getting a formal education should be the prospect of doing a profession that you enjoy rather than the prospect of making money or gaining status.

Does it take an education to pick up garbage? No. But why is education held on such a high pedestal when all complex societies need armies of ?uneducated? laborers willing to stoop down and take care of the trash? Something that I?m sure most white collar workers of the world would have a lot of difficulty doing.

There?s not a lot to say here except that this will be the best chocolate cake you ever bake. Ever. It has stood the test of time, fads, and the convenience of box cake mixes. This chocolate cake recipe first appeared in The Christian Science Monitor in the 1930s or ?40s. It was reintroduced to readers a few years ago in this?essay.

When my mom gave me cake tools for Christmas this year, an eight-layer cakemaker complete with a plastic wand with interchangeable parts for carving pretty patterns in the icing, I decided to put them to the test for a friend's New Year?s Eve birthday bash.

I don?t think I had even made a double-layer cake before attempting this towering masterpiece.

I layered the cake with alternating buttercream frosting and raspberry preserves that I heated in the microwave for about 10 seconds to get it to a spreadable texture. I covered the sides and top with a chocolate buttercream frosting. I adapted the frosting recipe a bit from the original recipe, made it less sweet, which I think works just fine ? because this is a really moist, dense cake.

On a whim I decided to use a few fresh flowers for a decorative touch, since I don't quite trust my skills yet to make frosting flowers.

It?s?delicious?either as a simple sheet cake or dressed up into a multilayer celebration cake.

There was just enough to give our revelers a nice big piece each ? and left the Birthday Girl with a giant piece to eat the next day, which she did for breakfast. While sweet endings are nice, sweet beginnings are even better.

Chocolate cake

2 cups sugar

1-1/2 sticks butter

1-1/2 cup boiling water

2 cups flour

1/2 cup unsweetened cocoa powder

2 teaspoons baking soda

1/2 teaspoon salt

2 eggs, beaten

1 teaspoon vanilla

Preheat oven to 350 degrees F. Grease and flour a 9- x 13-inch pan or two 9-inch round cake pans. If you are using round pans, it is recommend that you cut out a piece of parchment paper and line each pan, since this cake tends to stick.

Place butter and sugar in a large mixing bowl. Add boiling water and stir until the butter and sugar are dissolved.

Sift the dry ingredients into the batter and combine. Add eggs and vanilla extract and mix well.

Pour into prepared pan(s) and bake about 35 minutes, or until a knife inserted in the center comes out clean.

Note: Homecooks who have used this recipe find that the cake rises higher in the middle.

Vanilla Buttercream Icing

1/2 stick butter, room temperature

3 cups powdered sugar, sifted

1-2 tablespoons milk

1 teaspoon vanilla

Cream butter until fluffy, gradually add powdered sugar. Stir in milk, 1 teaspoon at a time, until you achieve the consistency you want. Add vanilla. This is a thick, rich icing.

Sift the dry ingredients (flour, cocoa, soda, salt) into the batter. Mix well. Add eggs and vanilla and mix until well combined.

Chocolate Buttercream Icing

1-1/2 sticks butter, room temperature

2 cups powdered sugar, sifted

3 egg yolks, unbeaten

6 1-ounce squares unsweetened baker?s chocolate

In the top of a double boiler, melt the chocolate completely. Remove from heat, allow to cool.

Cream butter until fluffy, gradually add powdered sugar. Beat in egg yolks, one at a time. Add in chocolate, beat until desired consistency.

27 die in Egypt riot after soccer violence verdict

CAIRO (AP) ? Angry relatives and residents rampaged through an Egyptian port city Saturday in rioting that killed at least 27 people after a judge sentenced nearly two dozen soccer fans to death for involvement in deadly violence after a game last year.

The unrest was the latest in a bout of violence that has left a total of 38 people dead in two days, including 11 killed in clashes between police and protesters marking Friday's second anniversary of the uprising that overthrew longtime leader Hosni Mubarak.

President Mohammed Morsi canceled a scheduled trip to Ethiopia Saturday and instead met for the first time with top generals as part of the newly formed National Defense Council.

The violence in Port Said erupted after a judge sentenced 21 people to death in connection with the Feb. 1 soccer melee that killed 74 fans of the Cairo-based Al-Ahly team. Executions in Egypt are usually carried out by hanging.

All the defendants ? who were not present in the courtroom Saturday for security reasons ? can appeal the verdict.

Judge Sobhi Abdel-Maguid did not give his reasoning when he read out the verdicts for 21 out of the 73 defendants Saturday. The verdict for the remaining 52 defendants, including nine security officials, is scheduled to be delivered March 9. Some have been charged with murder and others with assisting the attackers.

Die-hard soccer fans from both teams, known as Ultras, hold the police at least partially responsible for February's violence, which was the world's worst soccer violence in 15 years, saying officers at the game did nothing to stop the bloodshed. They also criticize Egypt's President Mohammed Morsi for doing little to reform the police force or the judiciary since he took office in July.

The opposition says Morsi, Egypt's first freely elected and civilian president, and his Muslim Brotherhood allies in government have failed to restore stability amid continued political turmoil and crime, and point to a worsening economy.

In a statement Saturday, the main opposition National Salvation Front said it holds Morsi responsible for "the excessive use of force by the security forces against protesters." They threatened to boycott upcoming parliamentary elections if Morsi does not meet their demands that include amending articles in the new constitution.

The Brotherhood said in its statement that "misleading" media outlets were to blame for "enflaming the people's hatred for the current regime and urging them to act violently."

Immediately after Saturday's verdict was read live on state TV, two policemen were shot dead outside Port Said's main prison when angry relatives tried to storm the facility to free the defendants. Police fired tear gas and rubber bullets, as well as live rounds, at the crowd outside the prison.

In other parts of the city, residents tried to storm the governor's office, police stations, the power station and the main court building. Residents occupied one police station in the east of Port Said.

The director of hospitals in Port Said, Dr. Abdel-Raham Farah, said two local soccer players were shot to death as they were apparently on their way to practice. He identified them as Mahmoud Abdel-Halim al-Dizawi, who played for the city's Al-Marikh club, and Tamer al-Fahla, who used to play for the city's main Al-Masry team. Al-Diwazi was shot three times, the doctor said.

The club they were training at is near the prison that residents tried to storm.

The military was deployed in Port Said to try to restore security, but assaults continued into the evening. The army was widely used to keep order by top generals who took over after Hosni Mubarak, but the military has kept a much lower profile since Morsi was elected.

Egyptian military forces also were sent into the canal city of Suez after eight people died in Friday's clashes between security forces and protesters opposed to the new president and the Brotherhood. Another protester was killed in Ismailiya, and security officials told the state news agency MENA that two policemen were killed in Friday's protests.

Many of the young men who led the protests and clashes hail from the Ultras. They often come from poor neighborhoods and view the police force that was the backbone of Mubarak's authoritarian rule as their nemesis.

"The police are thugs!" yelled relatives of the deceased inside the courtroom before the judge took the bench.

Near Cairo's Tahrir Square, where tens of thousands had amassed to mark the two-year anniversary a day earlier, Ultras Al-Ahly waved their team's red flag as they clashed with police who fired tear gas to disburse the crowd near Cabinet headquarters and Parliament.

Underlining the distrust that lingers between much of the public and the police, survivors and witnesses say Mubarak loyalists had a hand in instigating last year's attack, which began after Port Said's home team won the match, 3-1, and that the police at the very least were responsible for gross negligence.

Al-Masry fans stormed the pitch after the game ended, attacking Cairo's Al-Ahly fans. Authorities shut off the stadium lights, plunging it into darkness. In the exit corridor, the fleeing crowd pressed against a chained gate until it broke open. Many were crushed under the crowd of people trying to flee.

Other survivors said it was simply bloodthirsty Al-Masry fans and lack of enough security that led to the deaths of their colleagues. Both sides blame police for failing to perform usual searches for weapons at the stadium.

Anger is boiling in Port Said, where residents say they have been unfairly scapegoated.

A lawyer of one of the defendants given a death sentence said the verdict was political.

"There is nothing to say these people did anything and we don't understand what this verdict is based on," Mohammed al-Daw told The Associated Press by telephone.

"Our situation in Port Said is very grave because kids were taken from their homes for wearing green T-shirts," he said, referring to the Al-Masry team color.

Al-Daw and other defense attorneys said all those sentenced were Al-Masry fans. As is customary in Egypt, the death sentences will be sent to the nation's top religious authority, the Grand Mufti, for approval, though the court has final say on the matter.

Fans of Al-Ahly, whose stands were attacked by rival club Al-Masry in the incident in Port Said, had promised more violence in the days leading up to the verdict if the death penalty was not handed down.

Before the judge could read out the names of the 21, families erupted in relief, yelling "Allahu Akbar!" Arabic for "God is great," with their hands in the air and waving pictures of the deceased. One man fainted while others hugged one another. The judge smacked the bench several times to try to restore calm in the courtroom.

"This was necessary," said Nour al-Sabah, whose 17-year-old son Ahmed Zakaria died in last year's melee. "Now I want to see the guys when they are executed with my own eyes, just as they saw the murder of my son."

Thousands of Al-Ahly fans gathered outside the Cairo sports club for the verdict, chanting against the police and the government.

"We are not really that happy," Mohamed Ahmed, a survivor of the attack, said. "The government helped the Ultras of Port Said by blocking the gates of the stadium until people suffocated to death.

(AP) ? Rep. Paul Ryan says Republicans need to stay united and pick their fights during President Barack Obama's second term.

The party's vice presidential nominee from 2012 tells conservatives that Republicans need to reject the president's proposals in some cases and make them better in others.

The Wisconsin lawmaker said in a speech Saturday to the National Review Institute in Washington that Obama will try to divide Republicans. But Ryan says GOP lawmakers "can't get rattled" and shouldn't "play the villain in his morality plays."

Ryan defends his vote on the "fiscal cliff" deal. He says that if the measure hadn't passed, every single taxpayer would have paid higher taxes.

(AP) ? During her time in Iraq, Alma Felix would see her fellow female soldiers leave the Army installations where she worked at a desk job and head into combat with their male counterparts. But many returned home feeling that few knew of their contributions.

"I guess we do disappear into the background," the 27-year-old former Army specialist said. "You always hear we're losing our sons out there. And although women have fallen out there, you really don't see very much of it."

Now, with the Pentagon ending its ban on women in combat, Felix and other female troops hope the military's plan to open hundreds of thousands of combat jobs to them will lead society to recognize that they, too, can be courageous warriors.

"We are the support. Those are the positions we fill and that's a big deal ? we often run the show ? but people don't see that," she said. "Maybe it will put more females forward and give people a sense there are women out there fighting for our country.

"It's not just you're typical poster boy, GI Joes doing it," she said.

Thursday's announcement promises to change the image of battlefields around the world, as debate rages on whether women can fight like men. What's clear is that the move will pave the way for women to earn higher pay and earn better promotions.

The shift is the military's biggest since the policy banning openly gay service members was lifted in 2011. And as was the case with "don't ask, don't tell," troops were expected to fall in line with the new rules.

The change overturns a 1994 rule prohibiting women from being assigned to smaller ground combat units, and is expected to open up more than 230,000 combat positions that have been off limits to women.

"We owe it to them to allow them to pursue every avenue of military service for which they are fully prepared and qualified," said Defense Secretary Leon Panetta. He said women have shown they are willing to fight and die alongside their male counterparts.

Across the country, members of the military of both sexes said they accepted the policy so long as women will have to meet the same standards as their male colleagues. Both men and women were skeptical about putting females in infantry units, however.

"This gives us more people to work with," said Army Sgt. Jeremy Grayson, assigned to field infantry at Fort Bliss, Texas. "But they would have to be able to do the physical stuff that men do. ... They have to be able to pull their own weight."

Panetta said the qualifications will not be lowered and acknowledged that not all women will meet them. He said allowing women to serve in combat roles will strengthen the ability of the U.S. to win wars.

It will be up to the military service chiefs to recommend whether women should be excluded from more demanding and deadly positions, such as Navy SEALs or the Army's Delta Force.

Veterans and some in the military argue the public may not be ready to handle seeing more female troops come home in body bags or with lost limbs. "It's harder to see a mother or a daughter dead. We (men) are seen as protectors," said Army Staff Sgt. Anthony Lemaitre.

Army Spc. Jean Sardonas, who works as a lab technician at a hospital, said she understood Lemaitre's opinion.

Sardonas said she had thought about joining an Army team that conducts social work in the field and faces combat situations. But she's since become a mother, changing her perspective, and said women tend to be more emotional.

"If you see the enemy, well, that's the enemy, but now if you see a kid with a gun you're going to think twice," she said.

At McP's Irish Pub near the Navy SEALs base in Coronado, battle-hardened veterans chuckled and sighed at the news. There were no celebrations planned yet at the dark bar decorated with combat memorabilia, a framed article announcing the death of Osama bin Laden and a bronze plaque quoting W.C. Fields saying: "Marry an outdoors woman, then if you throw her out into the yard for the night, she can still survive."

"I think our culture instinctively teaches us to take care of women and we won't be combat ready," said the pub's owner and a former Navy SEAL, Greg McPartlin, who is a Bronze Star recipient. "We're more interested in protecting her than shooting the bad guy."

Felix bristles at that kind of thinking but has heard that from young male soldiers. "It's hard to see any comrade fall, whether it's a woman or a man," she said.

Women comprise about 14 percent of 1.4 million active military personnel. More than 280,000 women have been sent to Iraq, Afghanistan or to jobs in neighboring nations in support of the wars. And of the more than 6,600 U.S. service members who have been killed, 152 have been women.

The New York veteran who started the nation's first Veteran of Foreign Wars post for women welcomes them in elite forces. But making allowances for women would be "a detriment to the team," said Marlene Roll, who served with an Army Reserve medical unit during the first Gulf War. "If she can make it through the course and she can graduate, hell yeah."

Linda L. Bray was just glad to see the Pentagon finally laud women's bravery.

Bray said her male superiors were incredulous upon hearing that she had led dozens of male military police officers through a three-hour firefight during the 1989 invasion of Panama.

Instead of being lauded for her heroism, she said, higher-ranking officers accused her of embellishing accounts of what happened. Congress debated fiercely over whether she and other women had any business being on the battlefield.

"I think it's absolutely wonderful that our nation's military is taking steps to help women break the glass ceiling," said Bray, of Clemmons, N.C.

"I hope the women who attempt to take on these challenges in the military don't do it because now it's OK for them to do it," she said. "I hope they do it because they really want to make a go of being a man's partner in going to war."

Obama's recess appointments ruled unconstitutional

WASHINGTON (Reuters) - A federal appeals court on Friday invalidated President Barack Obama's "recess" appointments to a labor board last year, ruling that the move was unconstitutional and dealing a blow to Obama's strategy of bypassing Senate Republicans.

The three appointments to the National Labor Relations Board in January 2012 were made while the Senate was out of town but potentially available to act on them.

"Considering the text, history, and structure of the Constitution, these appointments were invalid from their inception," the panel said.

Obama also used such a "recess" appointment last January to install Richard Cordray as head of the Consumer Financial Protection Bureau, although his appointment was not part of the lawsuit.

The suit started as a routine dispute between soda bottling company Noel Canning and the labor board, but lawyers for Senate Republicans seized on the suit as a chance to challenge the appointments.

The case was seen as a test of the limits of the president's ability to make appointments during a Senate recess, a power that bypasses the Senate's usual ability to block nominees and that dates to the U.S. Constitution of 1787.

At the time, the Senate was not officially in recess, meeting every few days for minutes at a time but accomplishing no work and with few senators present. Meanwhile, Obama's nominees remained on the Senate's calendar, blocked by Republicans from up or down votes on their confirmation.

Nancy Cleeland, a spokeswoman for the NLRB, had no immediate comment.

Cordray's appointment was challenged in a separate lawsuit brought in June by the State National Bank of Big Spring, Texas, and other institutions. That suit presented a similar argument that the recess appointment was invalid because the Senate was technically in session.

Cordray's appointment followed months of rancorous debate over the new consumer bureau, which was created by the 2010 Dodd-Frank financial oversight law to police markets for products such as credit cards and home loans.

Once rare, recess appointments became more common in the late 1970s as a way to bypass the confirmation process, which senators have used increasingly to block nominees of both Republican and Democratic presidents.

Recent presidents pushed the boundaries. George W. Bush took the rare step of filling a judgeship during a recess, while Obama appointed the NLRB members while the Senate was holding "skeleton" sessions set up to keep it from going into recess.
